1. Introduction
Welcome to HarborZenCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at harborzencommons.sbs (the "Service") operated by HarborZenCommons.
By booking a charter or accessing our Service, you agree to these Terms. If you disagree with any part of the terms, you may not use the Service.
2. Service Overview
HarborZenCommons offers luxury yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are subject to change or discontinuation without notice and depend on availability and weather conditions.
3. Booking and Reservations
3.1 Booking Process
For charter reservation requirements you must:
- Be at least 18 years old
- Provide valid and complete information
- Make the required down payment as noted in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Booking confirmation is subject to receipt of payment and our written approval. Service may be declined at our discretion.
3.3 Availability
Charter bookings are contingent on vessel availability and favorable weather. We will try to accommodate your preferred schedule.
4. Payment Terms
4.1 Pricing
Prices are stated in € and include taxes unless stated otherwise. Prices may be subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost required at the time of booking
- Final Payment: Due 48 hours prior to the charter departure
- Any additional fees: Payable after the charter
4.3 Payment Methods
We accept various payment methods including major credit cards, bank transfers, and certified cheques. Our payment systems are secure and encrypted.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus transaction fees
- 24-72 hours before departure: 50% of the total is refunded
- Less than 24 hours before departure: No refund will be issued
5.2 Weather Cancellations
If weather conditions are deemed unsuitable by the captain, we may:
- Offer to reschedule the charter on another available date at no extra cost
- Providing a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there are mechanical problems with the assigned vessel, we will try to provide a compatible replacement. If unavailable, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers on board are obligated to:
- Comply with instructions from the crew
- Use the safety equipment as instructed
- Disclose any medical issues that might affect their safety during the charter
- Stay within designated areas of the yacht
6.2 Prohibited Items
The following are strictly prohibited on the yacht:
- Glass containers
- Illegal drugs
- Weapons of any kind
- Non-alcoholic drinks in excess of reasonable consumption for personal use
- Pets, unless previously sanctioned
6.3 Conduct
We expect passengers to behave respectfully at all times. Any activities that compromise safety or disrupt the charter for others may lead to early termination without refund.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is limited to the payment made for the charter. We do not cover:
- Injuries caused by the passenger's negligence
- The loss or damage of personal belongings
- Indirect or punitive damages
- Delays due to weather or situations outside of our control
7.2 Insurance Coverage
Our fleet is insured under comprehensive marine insurance policies. You are responsible for arranging your own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our services, you recognize that yachting carries inherent risks and accept personal accountability for your safety and effects.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, routes, or schedules for reasons such as weather, safety, or operational necessities. We aim to provide comparable alternative options wherever feasible.
9. Force Majeure
We are not liable for any hold-ups, cancellations, or alterations that happen due to circumstances beyond our control, including:
- Extreme weather situations
- Natural disasters
- Authority mandates
- Port shutdowns
- Technical breakdowns
10. Privacy and Data Protection
Your personal data is managed in line with our Privacy Policy. By using our services, you consent to our data collection and usage practices as outlined in our Privacy Policy.
11. Intellectual Property
Our website content, including text, imagery, and logos, is safeguarded by copyright and trademark legislations. Without our explicit consent, reproduction or distribution is prohibited.
12. Governing Law
The Terms are regulated by law in France. Disputes, if any, will be handled in courts situated in Nice, France.
13. Changes to Terms
We may adjust these Terms at any point. Updated versions will be posted online with the revision date noted. Continued use after changes equates to agreeing to the new terms.
